TXC DESIGNS – TERMS OF SERVICE

Welcome to TXC Designs. By accessing this website, creating an account, placing an order, or purchasing any product from TXC Designs, you acknowledge that you have read, understood, and agreed to these Terms of Service, including our Final Sale, No-Refund & Replacement Policy.

These Terms apply to all purchases made through the TXC Designs website and any other authorized TXC Designs sales channel.


1. GENERAL

By accessing, browsing, or purchasing from this website, you agree to be bound by these Terms of Service and all applicable laws and regulations.

TXC Designs reserves the right to update, modify, or replace any portion of these Terms at any time. Updated Terms become effective when posted to the website.

It is the customer's responsibility to review the applicable Terms before placing an order.


2. PRODUCTS AND PRODUCT INFORMATION

TXC Designs sells products designed for specific applications, bike models, model years, variants, and configurations.

Customers are responsible for reviewing all product information before purchasing, including:

  • Product descriptions

  • Specifications

  • Dimensions

  • Compatibility information

  • Bike model and year

  • Product variants

  • Brake configurations

  • Required hardware

  • Installation requirements

  • Pre-order or production status

  • Shipping information

  • This Terms of Service agreement

  • The TXC Designs Final Sale, No-Refund & Replacement Policy

TXC Designs is not responsible for customer selection errors made during checkout.

If you are uncertain whether a product is compatible with your bike, contact TXC Designs before placing your order.


3. ORDERS ARE FINAL

ALL TXC DESIGNS SALES ARE FINAL.

Once an order has been placed and payment has been successfully processed, the customer agrees that the order is final and is not eligible for customer-initiated cancellation, return, refund, exchange, or store credit.

This includes orders for products that are:

  • Pre-ordered

  • Made-to-order

  • Custom-built

  • Custom-painted

  • Custom-coated

  • Bike-specific

  • Supplier-procured specifically for the customer

  • Already in production

  • Already being fulfilled

TXC Designs may refuse, cancel, or hold an order when reasonably necessary, including in cases involving suspected fraud, payment issues, pricing errors, inventory errors, supplier issues, or violations of these Terms.

Nothing in these Terms limits rights or remedies that cannot legally be waived under applicable law.


4. NO-REFUND POLICY

TXC DESIGNS DOES NOT OFFER CUSTOMER-INITIATED REFUNDS.

Customers may not request a refund because of:

  • Change of mind

  • No longer wanting the product

  • Ordering the wrong product

  • Ordering the wrong model

  • Ordering the wrong bike variant

  • Ordering the wrong size

  • Incorrect customer selection

  • Personal preference

  • Installation difficulty

  • Failure to verify compatibility

  • Purchasing another product elsewhere

  • Deciding not to use the product

  • Normal cosmetic or performance expectations

  • Product not meeting a customer's personal preference

Customer-initiated returns are not eligible for a refund, exchange, or store credit.

For verified damaged, defective, missing, or incorrectly supplied products, the standard TXC Designs remedy is replacement only, subject to the requirements of our Replacement Policy.

This policy does not waive any refund or other remedy that applicable law expressly requires TXC Designs to provide.


5. FINAL SALE & REPLACEMENT-ONLY POLICY

The TXC Designs Final Sale, No-Refund & Replacement Policy is incorporated into these Terms by reference.

Under that policy:

All sales are final.

TXC Designs does not offer customer-initiated:

  • Refunds

  • Returns

  • Exchanges

  • Store credit

If a product is verified to have arrived:

  • Damaged

  • Defective

  • Missing a required component

  • Incorrectly supplied by TXC Designs

TXC Designs may provide an appropriate replacement product or replacement component after reviewing the claim.

A replacement is the standard remedy for an approved product issue.


6. DAMAGED, DEFECTIVE, INCORRECT, OR MISSING ITEMS

Customers must contact TXC Designs within 48 hours of confirmed delivery if they believe an order has arrived damaged, defective, incomplete, or incorrect.

Claims must include sufficient documentation for TXC Designs to investigate the issue.

Customers may be required to provide:

  • Order number

  • Description of the issue

  • Photos of the product

  • Photos of the shipping box

  • Photos of packaging materials

  • Videos demonstrating the issue

  • Installation photographs when fitment is involved

  • Measurements or technical information when requested

TXC Designs may request additional information before determining whether a claim qualifies for replacement.

Failure to provide requested documentation may prevent TXC Designs from verifying the claim.


7. REPLACEMENT-ONLY REMEDY

If TXC Designs determines that a product qualifies under the Replacement Policy, the standard remedy is:

REPLACEMENT ONLY.

Depending on the circumstances, TXC Designs may provide:

  • Replacement product

  • Replacement component

  • Replacement hardware

  • Corrected product

  • Missing component

  • Other appropriate replacement part

TXC Designs determines the appropriate replacement based on the nature of the verified issue, product availability, manufacturer requirements, and applicable warranty procedures.

An approved replacement claim does not create a general right to return the product for a refund.


8. PRODUCT COMPATIBILITY & FITMENT

Customers are solely responsible for verifying that the selected product is appropriate for their specific bike.

Compatibility may depend on:

  • Bike model

  • Model year

  • Variant

  • Generation

  • Brake configuration

  • Rotor size

  • Mounting configuration

  • Existing aftermarket components

  • Previous modifications

  • Other vehicle-specific specifications

Customers should contact TXC Designs before purchasing if they are uncertain about compatibility.

A product ordered for the wrong bike, model, year, variant, or configuration is not eligible for a refund, exchange, or customer-initiated return.

If the customer believes TXC Designs supplied incorrect compatibility information, the issue may be submitted for review under the Replacement Policy.


9. INSTALLED OR MODIFIED PRODUCTS

Products should not be installed, modified, altered, drilled, cut, painted, coated, bent, ground, welded, disassembled, or otherwise changed before a potential product issue is reported.

TXC Designs may deny a replacement claim when the product has been altered or damaged after delivery.

Examples include:

  • Incorrect installation

  • Installation damage

  • Drilling

  • Cutting

  • Grinding

  • Bending

  • Welding

  • Unauthorized repairs

  • Painting

  • Coating

  • Modification

  • Damage caused by improper use

  • Damage caused by misuse

  • Damage caused by another component

Do not modify a product to make it fit before contacting TXC Designs.


10. RETURN AUTHORIZATION

TXC Designs does not accept ordinary customer-initiated returns.

In certain circumstances, TXC Designs may require a product to be physically returned for:

  • Inspection

  • Manufacturer evaluation

  • Warranty review

  • Verification of a defect

  • Replacement processing

  • Investigation of an incorrect shipment

If TXC Designs requires a product to be returned, the customer will receive specific instructions.

Authorization to return an item for inspection does not constitute authorization for a refund.

A return shipping label, when provided, does not automatically mean that a refund has been approved.

Unless TXC Designs expressly states otherwise in writing, the applicable remedy remains replacement or another resolution permitted under the applicable Replacement Policy.


11. UNAUTHORIZED RETURNS

Customers must not send merchandise to TXC Designs without written authorization.

Unauthorized returns may be refused, returned to the sender, or held pending further instructions.

Receipt of merchandise by TXC Designs does not automatically create an entitlement to a refund, exchange, or store credit.


12. PRE-ORDERS & MADE-TO-ORDER PRODUCTS

Many TXC Designs products may be pre-ordered, made-to-order, custom-built, painted, coated, or specifically procured based on the customer's selected configuration.

Because these products may be produced specifically for an individual order:

  • Orders are final once processing or production begins.

  • Customers are responsible for selecting the correct product and configuration.

  • Customers may not cancel because they no longer wish to wait.

  • Production time may vary.

  • Supplier availability may affect fulfillment.

  • Custom products may not be restockable or resalable.

Specialized paint, coating, curing, assembly, manufacturing, and supplier procurement processes may require additional processing time.


13. ORDER CHANGES & CANCELLATIONS

Orders cannot be changed or canceled once processing, production, supplier procurement, or fulfillment has begun.

A shipping label may indicate that an order has entered the fulfillment process; however, label creation itself does not necessarily mean that the package has been physically handed to the carrier.

Customers should contact TXC Designs immediately if they believe an order contains an error.

TXC Designs will determine whether a requested change is operationally possible.

A customer request does not guarantee that an order can be changed or canceled.

Any cancellation or refund that TXC Designs is legally required to provide will be handled in accordance with applicable law.


14. SHIPPING & DELIVERY

Shipping and delivery estimates are provided for planning purposes and are not guaranteed unless expressly stated otherwise.

Delivery may be affected by:

  • Carrier delays

  • Weather

  • Customs

  • Supplier delays

  • Manufacturing delays

  • Inventory shortages

  • Transportation disruptions

  • Holidays

  • Address errors

  • Events outside TXC Designs' reasonable control

Customers are responsible for providing an accurate shipping address.

TXC Designs is not responsible for delays caused by incorrect customer-provided shipping information.

Where applicable, TXC Designs will provide tracking information once the shipment is processed.

Nothing in this section limits any rights customers may have under applicable federal or state law.


15. DELAYED ORDERS

TXC Designs makes reasonable efforts to provide accurate production and shipping estimates.

Because certain products are pre-ordered or made-to-order, estimated production and fulfillment times may change.

If TXC Designs becomes unable to meet a legally applicable promised shipping timeframe, TXC Designs will provide any notices, delay options, cancellation rights, or refunds required by applicable law.

Where legally permitted, customers who agree to a shipping delay remain bound by the applicable Final Sale and Replacement Policy.


16. PRICING & PAYMENT

All prices are listed in USD unless otherwise stated.

TXC Designs reserves the right to correct pricing, product, inventory, or promotional errors.

Payment must be successfully processed before an order enters processing.

Customers are responsible for:

  • Payment information

  • Billing information

  • Shipping information

  • Applicable taxes

  • Foreign transaction fees

  • Currency conversion fees

  • Bank fees

  • Card issuer fees

TXC Designs is not responsible for fees imposed by a customer's bank or payment provider.


17. CHARGEBACKS & PAYMENT DISPUTES

Customers are strongly encouraged to contact TXC Designs before initiating a payment dispute so that the issue can be reviewed and addressed.

TXC Designs maintains records relating to orders, including where applicable:

  • Order information

  • Payment records

  • Customer communications

  • Product information

  • Shipping records

  • Tracking information

  • Delivery confirmation

  • Support correspondence

  • Replacement claims

  • Return authorizations

  • Photographs and videos

  • Other documentation relevant to the transaction

If a customer initiates a chargeback or payment dispute, TXC Designs may provide relevant documentation to the payment processor, card network, bank, or other dispute-resolution entity.

Initiating a chargeback does not automatically establish that a customer is entitled to a refund.

Nothing in this section prohibits a customer from exercising rights provided by applicable law or applicable payment-network rules.


18. PRODUCT WARRANTY & DISCLAIMERS

To the maximum extent permitted by applicable law, products are provided subject to the applicable manufacturer's warranty, if any.

TXC Designs does not provide warranties beyond those expressly stated in writing.

Nothing in these Terms is intended to exclude or limit warranties, consumer protections, or statutory rights that cannot legally be excluded or limited.

Products should be installed and used according to applicable manufacturer instructions.

TXC Designs is not responsible for damage resulting from:

  • Improper installation

  • Misuse

  • Abuse

  • Unauthorized modification

  • Racing or competition use where prohibited by the manufacturer

  • Improper maintenance

  • Incorrect fitment selection

  • Failure to follow manufacturer instructions

  • Use outside the product's intended application


19. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, TXC Designs shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the purchase, installation, use, inability to use, or performance of a product.

To the maximum extent permitted by law, TXC Designs' aggregate liability relating to a particular order shall not exceed the amount actually paid to TXC Designs for the product giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited or excluded.


20. USER CONDUCT

Customers agree not to:

  • Use the website for unlawful purposes

  • Provide fraudulent information

  • Use stolen payment information

  • Attempt unauthorized access

  • Interfere with website operations

  • Submit fraudulent replacement claims

  • Submit intentionally misleading information

  • Abuse the replacement process

  • Attempt to circumvent TXC Designs policies through multiple accounts or transactions

  • Engage in fraudulent chargeback activity

TXC Designs reserves the right to refuse service, restrict access, cancel orders, or investigate transactions where fraud, abuse, or policy violations are reasonably suspected.


21. FRAUD & ABUSE

TXC Designs reserves the right to investigate transactions that appear fraudulent, abusive, or inconsistent with normal purchasing activity.

This may include:

  • Multiple suspicious orders

  • Payment inconsistencies

  • Repeated replacement claims

  • False damage claims

  • Manipulated photographs or videos

  • Unauthorized payment methods

  • Suspicious shipping addresses

  • Repeated chargebacks

  • Other conduct suggesting fraud or abuse

TXC Designs may take appropriate action, subject to applicable law.


22. GOVERNING LAW

These Terms shall be governed by applicable law.

To the extent permitted by applicable law, disputes relating to these Terms or a transaction with TXC Designs shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any forum-selection provision shall apply only to the extent enforceable under applicable law.


23. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be limited or removed only to the extent necessary, and the remaining provisions shall remain in full force and effect.


24. ENTIRE AGREEMENT

These Terms, together with the TXC Designs Final Sale, No-Refund & Replacement Policy and any other policies expressly incorporated into the website, constitute the agreement between the customer and TXC Designs regarding the purchase and use of TXC Designs products.

Any representation inconsistent with these written policies must be authorized by TXC Designs in writing.


25. CUSTOMER ACKNOWLEDGMENT

By placing an order with TXC Designs, the customer acknowledges and agrees that:

✓ All sales are final.

✓ Customer-initiated refunds are not offered.

✓ Customer-initiated returns, exchanges, and store credit are not offered.

✓ Customers are responsible for verifying product compatibility before purchase.

✓ Verified damaged, defective, missing, or incorrectly supplied products are handled through a replacement-only process, subject to eligibility.

✓ Products should not be installed or modified before a potential issue is reported to TXC Designs.

✓ A return authorization or shipping label does not automatically authorize a refund.

✓ A replacement claim must be submitted within the applicable claim period and supported by the required documentation.

✓ Applicable federal and state laws may provide rights that cannot legally be waived.
